A simple guide to Conveyancing - Selling your property

1 - OFFER

OFFER - Once an offer has been made on your property, the Estate Agent will forward the memorandum of sale to your chosen solicitor.  Within a couple of days of receiving the information, your solicitor will write to you with an initial client care letter.

2 - CONTRACT

CONTRACT - Once you return the completed forms, your solicitor will be able to issue the draft contract to the Buyer’s solicitors. Your solicitor will to do this within 1-2 weeks of receipt of the papers.

3 - searches

& ENQUIRIES

SEARCHES - Within 1-2 weeks the Buyer’s solicitor will raise enquiries, which your solicitor

will send to you for instructions. At the same time, you may also be sent the contract and

any other required documentation for signature. The Buyer’s solicitor should have applied for their searches at this point, which can take on average 2-3 weeks to be received.

 

Depending on the enquiries raised, it can take anywhere between 6-8 weeks for the

Buyer’s solicitor to be satisfied. The Buyer should within this time receive their mortgage offer (if required).

4 - PRE-EXCHANGE

PRE-EXCHANGE- Discuss completion dates with your solicitor, if not already done so. If there is a chain, it may take a little longer for all parties to be ready.

5 - EXCHANGE

EXCHANGE - Your solicitor will request a redemption statement from your mortgage

lender (if required). At this point, the timescale will be set by contract depending on when the completion date.

6 - your final

COMPLETION !

COMPLETION - On completion, the Buyer’s solicitor will arrange to send the completion funds to your solicitor first thing in the morning. Depending on who the Buyer’s solicitors bank with and how busy the banking system is that day, the money can arrive instantly or take an hour or so to be received. Once received, your solicitor will telephone you to

confirm that completion had happened. You should ensure the keys are with the Estate Agents. Normally, completion should take place by 2pm (this time can be change by the contract depending on the transaction).

This guide is based on a straightforward freehold transaction. Leasehold transactions will take longer as information is requested

from the Landlord/Management Company which can take anywhere between 3-4 weeks to be received.
